    Constitutional jurisdiction in times of algorithmization: limits and possibilities for the protection of fundamental rights in the digital environment

    Abstract

    The growing automation of decisions in public and private sectors through algorithmic and artificial intelligence (AI) systems has deeply impacted fundamental rights and the structure of the Rule of Law. This paper analyzes the role of Brazilian constitutional jurisdiction in facing the challenges posed by algorithmic decision-making and its effects on principles such as equality, due process, and transparency. Using a qualitative and analytical approach, based on Supreme Federal Court (STF) rulings and theoretical references, it investigates how constitutional jurisdiction can establish normative parameters to ensure effective protection of fundamental rights in the digital age. The study concludes that the STF must adopt a dialogical and anti-discriminatory stance guided by a digital constitutionalism framework.
